Welcome to Mealboy.ca (“Mealboy”, “we”, “us”, or “our”). By accessing or using our website, placing orders, or subscribing to any of our services, you agree to these Terms & Conditions. Please read carefully before using our services.
1. General Information

Mealboy.ca provides freshly prepared meal delivery services, including tiffin-style meals, daily orders, and subscription plans.

We reserve the right to modify, suspend, or discontinue services at any time without notice.

All users must comply with applicable laws, these Terms & Conditions, and any additional policies posted on our site.
2. Account Registration and Orders

Accurate personal information (name, delivery address, phone number, payment method) must be provided.

Orders are subject to availability. Mealboy may refuse, cancel, or modify orders for incomplete, fraudulent, or inaccurate information.

By placing an order, you authorize us to charge your selected payment method for the full order amount.
3. Pricing and Payment

Prices are in CAD and may change without notice.

Taxes are included or added at checkout.

Accepted payments: credit/debit card, Interac e-transfer, or cash (certain orders only).
Cash payments for monthly orders are final and non-refundable.
4. Subscriptions, Skips, and Pauses

Subscription plans are subject to the Skip/Pause Policy:

Monthly Plans: Up to 4 skips per month or 1 pause per month (not both), with Request notice 1 day before 11:59 PM (Requests can be accessed in the requests page).

Short-term plans (1–4 days or weekly): Skip/Pause not available.

Subscription cancellations are reviewed case by case; fees may apply.
5. Delivery Policy
5.1 Route-Based Delivery

We use a route-based sequential delivery system for efficiency.

Specific delivery times cannot be guaranteed; approximate windows are provided.
5.2 Delivery Windows

Daytime: 8:00 AM – 2:00 PM (farther areas may extend to 3:00 PM)

Evening (Selected Areas): 2:00 PM – 8:00 PM
-
Timing may vary by 45–60 minutes due to traffic, road closures, or weather.
5.3 Instructions, Proof, and Safety

Provide clear ground-level drop-off instructions.

“Call on Arrival”: driver waits up to 5 minutes, then leaves meal at a safe spot or proceeds.

Meals left per instructions are considered delivered; no refund for theft after delivery.
-
Upstairs delivery only available if purchased.
-
Tracking links with 30–45 minute ETA may be sent via SMS/email; ETA may fluctuate.
-
Meals may arrive cool to maintain freshness; customers should reheat before consumption.
6. Refunds, Returns, and Store Credit

Refunds, store credits, and replacements are governed by the Refund & Service Policy.

Eligible situations: incorrect orders, missing items, or smaller portions than ordered (difference issued as store credit).

Refunds for monthly packages paid by credit/debit/Interac:

Deduct consumed meals (per-day weekly price)

Deduct administrative fees ($10 standard)

Remaining balance refunded to original payment method (5–7 business days).

Reports must be submitted within 24 hours of delivery.

Refunds are not provided for personal taste, consumed >25%, or tampered meals.
7. Customer Responsibilities

Provide accurate delivery details.

Ensure delivery location is safe and accessible.

Follow food safety guidelines for reheating and storage.
-
Report issues within timelines in the Refund & Service Policy.
8. Intellectual Property

All content on Mealboy.ca, including images, logos, text, and designs, is the property of Mealboy or its licensors.

Unauthorized use, copying, or distribution is prohibited.
9. Disclaimer of Warranties; Limitation of Liability

Use of the service is at your sole risk.

Mealboy makes no guarantees regarding uninterrupted, timely, secure, or error-free service.

Meals, services, and the website are provided “as is” and “as available”, without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, durability, or non-infringement.

Mealboy is not liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, revenue, savings, or data, arising from use of the service or products.

Some jurisdictions do not allow exclusion of liability for incidental/consequential damages; in such cases, liability is limited to the maximum extent allowed by law.
10. Indemnification
You agree to indemnify and hold harmless Mealboy, its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, damages, or expenses (including attorney fees) arising from:

11. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, it will be severed, and the remainder will remain in effect.
12. Termination

These Terms remain in effect until terminated by either party.

Mealboy may terminate access without notice for violation of Terms or misuse.

Obligations and liabilities incurred prior to termination survive the termination.
13. Entire Agreement

These Terms, together with Refund, Delivery, Skip/Pause, and Privacy Policies, constitute the entire agreement between you and Mealboy.

Ambiguities are not construed against the drafting party.

No prior agreements, proposals, or communications override these Terms.
14. Privacy

Personal data is collected, used, and stored as described in our Privacy Policy.

Use of our services constitutes consent to collection and use of data.
15. Governing Law

These Terms are governed by the laws of Canada, specifically Ontario.

All disputes fall under the exclusive jurisdiction of Ontario courts.
